Madonna is being sued by a company claiming she stole the "Material Girl" name from them, TMZ.com reports. L.A. Triumph, Inc. says its been marketing "Material Girl" clothes since 1997. It wants to receive all profits made from Madonna's new clothing line so far and for a judge to rule that using the same name constitutes "deception."
Madonna's first Material Girl collection hit stores earlier this month. Her daughter, Lourdes, was said to be the creative force behind the duds and she blogged extensively in advance of the launch. The line has already come under fire for ripping off one of Ronny Kobo's pieces for Torn.

A clothing company is taking legal action against Madonna, claiming the material girl has ripped off the "Material Girl" trademark.
L.A. Triumph, Inc. claims in a new lawsuit it's been marketing "Material Girl" clothing since 1997, selling millions of bucks worth of threads under its trademark.
According to the documents, obtained by TMZ, Madonna, aka Madonna Louise Veronica Ciccone, has jacked the name "Material Girl" for her junior clothing line Material Girl Brand -- which launched this year.
L.A. Triumph wants a declaration from a federal judge that Madonna's use of "Material Girl" creates "deception" in the marketplace.
In addition to the declaration, L.A. Triumph wants the judge to order Madonna and her company to turn over all of the profits they've made from their clothing line.
We've called Madonna's rep. So far, no comment.

This one is so close I had trouble telling which image was which for a good ten minutes. One clever tipster, upon seeing a piece from Madonna’s new line for Macy’s, pointed out that the “Material Girl” line blatantly rips off a design from Ronny Kobo’s work for Torn.
I mean, it’s identical–the pattern, the cut of the top, and even the arrangement of the embellishments. There’s nothing “Borderline” about it– Madonna’s been a “Bad Girl.” What’s your take?

Madonna is being sued over the rights to use the name Material Girl for her clothing range with daughter Lourdes.
Madonna is being sued over her clothing line.
The '4 Minutes' singer - who worked on a range of clothes entitled Material Girl with her 13-year-old daughter Lourdes - is being sued by LA Triumph for using the same name as their clothing collection.
Lawyer Peter Afrasiabi told X17online: "Our client and its predecessor have been continually selling similar clothes in similar retail outlets at similar price points under the Material Girl brand since at least 1997 and Madonna and her new-found company do not have the right to trade in the same space under this brand."
Chris Arledge, an intellectual property lawyer, added: "As a result of their acts, our client faces a risk of being subsumed by Madonna's profile, obvious worldwide notoriety and the massive spending campaign by Madonna, her company and retailers on her behalf."
Last month, Lourdes' father Carlos Leon admitted the teenager was the "creative force" of the clothing range, which is sold as US department store Macy's.
He said: "She's 100 per cent the creative force of Material Girl. She knew exactly what she wanted.
"She's a trendsetter that draws from all different things to put together a look. She's into different cultures and brings that into her style."

A clothing company is suing the fashion-forward entertainer for stealing its trademarked "Material Girl" name for her own brand, TMZ.com reported yesterday.
L.A. Triumph Inc. claims in a federal lawsuit that the "Material Girl" line being marketed by Madonna rips off its own products which have been selling since 1997. Madonna launched the venture in July.

Ever since her song of the same name became a smash hit in 1985, everyone has referred to Madonna as "The Material Girl." Sadly for the singer, it's become the bane of her existence in more ways than one.
"I hate that name," she tells Britain's Daily Star. "Everyone relates that title to me because of the song I did like 300 years ago. It's a title I got stuck with. When I first did the song it was meant in an ironic way, as I don't think of myself as a materialistic person. I hate that name but I do love clothes and fashion and I love beautiful things."
Despite the counterintuitiveness of that last statement, I'd avoid shouting "hey, yo, it's The Material Girl" if you see Madonna walking down the street since it'll get ya an overly muscled elbow to the face.
But loathing a nickname is one thing -- being accused of stealing it as quite another. According to TMZ, Madonna is also being sued for calling the new Macy's clothing line she started with daughter Lourdes, Material Girl.
In court documents, L.A. Triumph, Inc. claims they've been marketing "Material Girl" clothing since 1997 and her like-named line is infringing on their profits. In addition to alleging it creates "deception" in the marketplace, they're asking for all the profits Madonna has earned thus far.
What surprises me is that Madonna didn't prevent the company from calling the line Material Girl in the first place. It obviously implied her cooperation since -- as she bemoans -- everyone has been calling her that since the late 80's.
I would guess that the driving force behind L.A. Triumph's suit against Madonna can be best explained by the song itself: "Experience has made me rich and now they're after me, 'cause everybody's ... living in a material world (material)."

The song “Material Girl” was a worldwide hit for the pop star in 1985 and she recently chose it as the title for a fashion collection aimed at teenagers.
The clothes were designed with the help of her 13-year-old daughter Lourdes and launched at Macy’s in New York earlier this month. They include 1980s-style lace minidresses and sequinned hot pants.
But clothing company LA Triumph is taking her to court, claiming it has been using the Material Girl brand since 1997.
According to court documents obtained by the celebrity website TMZ, the company is accusing Madonna, who is listed as Madonna Louise Veronica Ciccone, of creating “deception” in the marketplace.
It is asking a judge to stop her use of the name “Material Girl” and wants all profits made from the clothing line so far.
In a statement a lawyer for the company told People magazine it had been “continually selling similar clothes in similar retail outlets at similar price points under their Material Girl brand since at least 1997.
“Madonna and her new-found company do not have the right to trade in the same space under this brand,” The company claimed it faced “a risk of being subsumed by Madonna’s profile, obvious worldwide notoriety” and the marketing campaign for her clothes.
Madonna has yet to comment.

Madonna Sued for Naming Her Macy’s Line ‘Material Girl’

Maybe there's no point in being the Material Girl if the material you create for girls 25 years after you become the Material Girl can't bear that label. L.A. Triumph Inc. is suing Madonna for trademark infringement, claiming they have been marketing and making millions off their own Material Girl clothing line since 1997. The company wants authorities to officially decide that Madonna's new Macy's juniors' Material Girl line is deceiving, and that Madonna must give them all profits from the Macy's line. This sounds like creative legalese that Madonna can probably buy her way out of since she is the Material Girl. But if she has to change the name of the Macy's line, "Like a Virgin" is equally iconic and, the clothes being targeted to 14-year-olds, much funnier.
